We strive to describe all Services, features, and offerings on Alothia accurately and transparently. However, you acknowledge and accept that actual availability, functionality, and content delivery may vary due to platform updates, continuous improvements, or adjustments based on user feedback, beta-phase development, or other operational needs.

12.2
Alothia is currently in an active beta launch phase.
During this period:
  • Certain meditation stacks, features, or full course formats may be incomplete or in development
  • Not all advertised functionality will be immediately available
  • Changes to the structure, order, or labeling of services may occur without advance notice
  • Rollouts may be staggered or limited to specific user segments, regions, or device types

13. Orders and Provision of Services

13.1
No part of the Alothia website, mobile application, or marketing materials constitutes a contractual offer capable of acceptance. By placing an order—whether for a subscription, digital product, stack access, or one-on-one session—you are making a contractual offer to purchase Services from The Purpose of Consciousness LLC.

We reserve the sole and absolute right to accept or reject any such offer. Our acceptance occurs only upon issuance of a formal order confirmation email or system notification, at which point a binding contract is formed.

13.2
Upon acceptance of your order: confirmations under sub-Clause 13.1 will be sent to you before the Services begin and shall contain the following information:
  • 13.2.1 You will receive a confirmation detailing the Services you have purchased, including a description of the main features and intended use.
  • 13.2.2 Your confirmation will include itemized pricing, including any applicable taxes, access charges, or recurring fees.
  • 13.2.3 You will receive relevant information regarding access credentials, estimated activation windows, session scheduling (where applicable), and system use instructions.
  • 13.2.4 If the Services include time-sensitive or limited features (such as beta features or seasonal pricing), that will be disclosed during the checkout process.

13.3

If we are unable or unwilling to accept your order (due to payment failure, Service unavailability, user eligibility issues, or suspected misuse), no payment will be captured where technically feasible. If payment has already been authorized or captured, we will issue a refund within 14 calendar days, unless fraudulent activity is suspected.

13.4
Payment is processed via the method selected at checkout. Setup or activation fees, if applicable, are charged immediately, and subscription billing will recur automatically on the same day of each billing cycle (monthly, quarterly, or annually, depending on your plan).
Charges may reflect:
  • Flat-fee plans
  • Pro-rated upgrades or downgrades
  • Add-ons, one-time sessions, or transaction-based fees
  • Recurring services tied to usage or plan duration

13.5
We aim to activate most digital services within 2–3 working days after acceptance of your order.
However, you acknowledge that:
  • Time is not of the essence of the contract
  • Minor delays, technical issues, or rollout schedules do not entitle you to cancel your order or claim compensation
  • For time-sensitive Services beginning within 14 calendar days of your order, you must expressly acknowledge that your statutory right to cancel (see Clause 14) may be affected or waived

13.6
We commit to using reasonable care and skill in the provisioning of all Services, consistent with accepted best practices in wellness, educational, and digital delivery sectors.
However:
  • We do not guarantee any specific outcome (mental, emotional, physical, or otherwise) from use of the platform
  • We do not offer warranties of compatibility, accuracy, or fitness for a particular purpose
  • No coaching session, meditation protocol, or AI-generated response constitutes regulated medical or therapeutic advice

13.7 If you receive Services that are materially inconsistent with your order (e.g., incorrect plan access, delivery errors, billing mismatches), you must notify us within 5 business days.
Depending on the issue, we may:
  • Adjust or correct your access rights
  • Issue a partial refund or credit
  • Extend platform access to remedy the disruption
  • We are not responsible for:
  • Issues resulting from incorrect or outdated user-submitted information
  • Missed communications due to your failure to monitor your email or spam folder

13.8
Certain Services—such as premium stacks, brain-scanning integrations, affiliate features, or group facilitation tools—may be subject to additional terms and conditions. These terms will be presented during signup, order completion, or prior to activation of that specific feature. In case of conflict between these Terms and any such Supplemental Terms, the Supplemental Terms shall govern the affected Service only.

13.9
We offer limited technical support via email and in-app messaging. Our standard response window is 24–72 hours, excluding weekends and U.S. holidays.

Support is prioritized based on severity, not on plan tier or order size, and no Service Level Agreement (SLA) applies unless explicitly contracted in writing.

14. Cancellation of Orders and Services

14.1 General Cancellation Policy
We want you to be fully satisfied with your experience using the products and services offered by The Purpose of Consciousness LLC through the Alothia platform. If you have any questions, concerns, or wish to discuss a cancellation, please contact our support team via help@alothia.com or by writing to our business address listed in Clause 1 of these Terms.

You have the right to request the cancellation of any order that has been accepted by us and/or to withdraw from your contractual relationship with us, subject to the provisions of this Clause and any Specific Terms associated with your purchase.

If the Service or product you purchased includes additional cancellation conditions (such as digital goods, live session access, or time-based subscriptions), those Specific Terms shall take precedence over this Clause.

14.2 Right to Cancel – EU and International Consumers
14.2.1
If you are a consumer located within the European Union (or in a jurisdiction with similar consumer protection laws), you are entitled to a 14-day “cooling off” period.
  • This period begins on the date your order is confirmed (i.e., when we send your order confirmation email or platform receipt), and ends 14 calendar days thereafter.
  • If you wish to cancel during this time, please notify us in writing by emailing help@alothia.com with your full name, email, order number, and reason for cancellation.

14.2.2
The right to cancel within this period applies only if:

14.3.1
If you request or consent to immediate access to Services before the 14-day cooling-off period has ended (e.g., accessing a digital stack, booking a one-on-one session, or using subscriber features), you expressly acknowledge and agree that:
  • Your right to cancel may be partially or fully waived, depending on the extent of Services already provided
  • You are responsible for all prorated usage or consumed Services as of the date you notify us of your intent to cancel

14.3.2
If the Services have been fully performed (i.e., access granted, session completed, content consumed) within the 14-day period, your right to cancel is forfeited in full

14.3.3
If Services are partially delivered, and you cancel during the cooling-off window:
  • You will be charged proportionally based on the amount of Service already delivered
  • Any refund due will be calculated by deducting the prorated value of Services rendered
  • Refunds, if applicable, will be processed within 5 to 14 business days from the date of valid cancellation notice

14.4 Non-Refundable Circumstances
14.4.1
You will not be entitled to any refund, in full or in part, in the following situations:
  • The Services purchased have been fully performed or consumed
  • The cancellation request is made after the 14-day cooling-off period has elapsed, unless otherwise specified by law or contract
  • Your Account was suspended or terminated due to a breach of these Terms or abusive behavior (see Clause 9 and 10)
  • You have knowingly attempted to bypass restrictions or duplicate access (e.g., through multiple trial accounts or shared credentials)
  • Services were delivered under beta-phase pricing or promotional terms clearly labeled as non-refundable

14.4.2
Alothia's Services are digital and personalized in nature. As such, refunds are rarely available outside the conditions outlined above. Please consider this before purchasing, especially for one-time sessions, limited stack access, or paid coaching formats.

14.5 Refund Processing and Timing

Where refunds are approved:
  • Processing will occur within 5 business days, and in no event later than 14 calendar days after confirmation of your eligibility
  • Refunds will be issued to the original payment method used
  • You may receive a notification confirming refund issuance; however, bank or card provider processing times may vary

14.6 Post-Cooling-Off Period Cancellations

14.6.1
If the 14-day cooling-off period has expired, any cancellation will be subject to:
  • The terms of your specific subscription or product
  • Any minimum contract duration or renewal window
  • The limitations described in Clauses 13 and 14

14.6.2
You may still request cancellation of a recurring subscription at any time by emailing help@alothia.com. Cancellations will apply only to future billing cycles.
No prorated refund will be issued for the unused portion of the current billing period unless required by law.

14.7 Waiver of Discretionary Refunds

You acknowledge and agree that any refunds issued outside of this Clause are discretionary, and do not create a precedent or right for future claims.
We reserve the right to reject refund requests for any reason not expressly covered above, even if similar requests were honored in the past.

18.4
In recognition of this phased availability, we have implemented a reduced pricing model and offer only quarterly billing (rather than monthly) to align with our development roadmap. Pricing and access models may change upon completion of beta and release of the full library.

18.5
We are not obligated to maintain any feature or tier indefinitely, and changes to the structure, content, or business model of the platform will not entitle users to compensation unless required by law.

19. Availability of the Website

19.1
The Website and mobile applications are provided on an "as is" and "as available" basis. No express or implied guarantee is made that they will be available continuously, error-free, or fully functional at all times.

19.2
You expressly acknowledge that Alothia is in a beta testing phase. Certain tools, content stacks, integrations, and user experience features may be incomplete, temporarily disabled, or undergo frequent updates.

19.3
We do not guarantee uninterrupted access or uptime and disclaim liability for any temporary disruptions, including those caused by:
  • Maintenance windows or feature deployments
  • Third-party hosting provider downtime
  • Technical issues associated with beta-phase infrastructure
  • Performance issues related to scale or platform transitions

19.4
The reduced subscription pricing offered during this beta phase reflects these limitations and is temporary. Refunds will not be provided solely on the basis of reduced feature availability during beta, unless otherwise specified by local consumer protection law.

26. Disclaimers of Use, Medical Reliance & Coaching Restrictions

26.1 No Medical Advice

Alothia is a wellness, fitness, and education platform—not a medical, diagnostic, or therapeutic service.

Nothing on our websites, in our mobile applications, or delivered through our Services—whether written, spoken, visual, or implied—constitutes or substitutes for:
  • Medical advice
  • Mental health or psychiatric diagnosis
  • Prescription, treatment, or prognosis
  • Therapeutic intervention or counseling
  • Any clinical evaluation or regulated healthcare service

26.2 Health & Fitness Disclaimers

Our meditation stacks, stress recovery protocols, weight-loss programs, body composition guidance, energy work, and mental rebalancing tools are designed for general wellness support only.
While many of our coaches are certified fitness trainers, meditation specialists, or holistic nutritionists, their guidance must not be interpreted as personalized medical treatment or health prescriptions.

We strongly encourage users to seek a second opinion, and ideally a third opinion, from licensed medical professionals before acting on any health-related suggestion offered through Alothia.

26.3 Assumption of Risk

By using Alothia, you acknowledge and accept that:
  • All physical, emotional, or psychological practices introduced on the platform carry inherent risk
  • You are responsible for your own health choices and interpretations
  • Outcomes may vary by individual and are not guaranteed
  • You should consult a qualified physician before beginning any physical training, dietary change, or intense meditation stack, especially if you have a history of trauma, cardiovascular issues, respiratory conditions, seizures, or psychiatric diagnoses

26.4 One-on-One Coaching Disclaimers

Alothia may offer optional live sessions with certified trainers, meditation facilitators, or nutrition coaches.
These sessions are:
  • Advisory in nature only
  • Not intended to diagnose or treat any physical, mental, or emotional condition
  • Subject to your independent evaluation and application

All coaching content is offered as supportive guidance, not as a substitute for regulated or licensed professional services. You assume full responsibility for any decisions made or actions taken based on coaching advice.

26.5 Restrictions for Minors

Children under the age of 18 are strictly prohibited from booking or participating in one-on-one sessions without an adult present.
  • All Zoom or live sessions involving a minor must include a parent or legal guardian present throughout the entire session.
  • Minors may not operate an Alothia account independently to bypass these rules.
  • Any Account found to be operated primarily by a minor, or used to access unsupervised coaching sessions by a minor, may be suspended or permanently revoked without refund.
